ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND WAIVER AGREEMENT

PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCESSING, PURCHASING, OR PARTICIPATING IN ANY LUMA LAB PROGRAM, CLASS, WORKOUT, OR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THE TERMS OF THIS AGREEMENT.

1. ASSUMPTION OF RISK

I understand that participation in fitness, exercise, yoga, Pilates, strength training, mobility training, stretching, cardiovascular exercise, wellness programming, and related activities involves inherent risks. These risks may include, but are not limited to:

• Muscle strains and sprains
• Joint injuries
• Falls
• Equipment-related injuries
• Dizziness, fainting, or dehydration
• Aggravation of pre-existing conditions
• Serious injury, disability, or death

I knowingly and voluntarily assume all risks, known and unknown, associated with my participation in any Luma Lab program, workout, class, or service.

2. HEALTH AND MEDICAL ACKNOWLEDGMENT

I represent that I am physically capable of participating in exercise activities and have no medical condition that would prevent safe participation.

I understand that Luma Lab Fitness LLC, its owners, instructors, employees, contractors, and affiliates are not medical professionals and do not provide medical advice, diagnosis, treatment, or rehabilitation services.

I acknowledge that I should consult with my physician or qualified healthcare provider before beginning any exercise program and before participating in any Luma Lab content if I have concerns regarding my health or physical condition.

3. PREGNANCY AND POSTPARTUM PARTICIPATION

If I am pregnant, recently postpartum, or have any pregnancy-related medical concerns, I acknowledge that participation is entirely voluntary and at my own risk.

I understand that:

• Exercise recommendations during pregnancy and postpartum recovery vary by individual.
• Modifications provided by Luma Lab are general educational guidance and may not be appropriate for every participant.
• Luma Lab does not guarantee the safety or suitability of any exercise during pregnancy or postpartum recovery.

I agree to consult my healthcare provider regarding participation and accept full responsibility for determining whether any exercise is appropriate for me.

4. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Luma Lab Fitness LLC, its owners, members, officers, employees, instructors, contractors, affiliates, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, damages, liabilities, costs, expenses, actions, or causes of action arising out of or related to:

• Participation in any workout, class, challenge, or program
• Use of any exercise instruction or educational content
• Use of any website, video, downloadable content, or digital service provided by Luma Lab
• Personal injury, illness, disability, property damage, or death

whether caused by negligence or otherwise, except where prohibited by applicable law.

5. NO GUARANTEE OF RESULTS

I understand that individual results vary and that Luma Lab makes no guarantees regarding:

• Weight loss
• Physical appearance
• Strength gains
• Athletic performance
• Health improvements
• Any other fitness-related outcome

Results depend on numerous factors, including consistency, effort, nutrition, genetics, lifestyle, and individual circumstances.

6. USER RESPONSIBILITY

I agree that I am solely responsible for:

• Exercising within my personal limits and abilities
• Maintaining a safe exercise environment
• Using proper equipment when necessary
• Stopping exercise immediately if I experience pain, dizziness, shortness of breath, or other concerning symptoms
• Seeking medical attention when appropriate

I understand that I am responsible for my own health and safety at all times.

7. ONLINE CONTENT DISCLAIMER

I acknowledge that Luma Lab provides digital fitness content intended for general educational and informational purposes.

Because instructors cannot observe participants directly, Luma Lab cannot assess individual fitness levels, physical limitations, injuries, or medical conditions. I accept full responsibility for my participation in any online content.

8. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from my use of Luma Lab services, violation of this Agreement, or participation in any activity associated with Luma Lab.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles.

Any dispute arising out of or relating to this Agreement shall be brought exclusively in a state or federal court located in Wisconsin, and I consent to the jurisdiction of such courts.

10. SEVERABILITY

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

11. ACKNOWLEDGMENT

BY ACCESSING, PURCHASING, OR PARTICIPATING IN ANY LUMA LAB PROGRAM, I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND VOLUNTARILY AGREE TO BE BOUND BY IT. I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
